Child Sexual Abuse and Exploitation
1. Zero-Tolerance Policy Statement
OpenSocial Intellectrax Private Limited (“Sikhami,” “we,” “us,” “our”) maintains an absolute zero-tolerance policy towards Child Sexual Abuse and Exploitation (CSAE) and the possession, creation, or distribution of Child Sexual Abuse Material (CSAM) on its platform.
We recognize our profound ethical and legal responsibility to protect the children and minors using our platform. This policy underscores our unwavering commitment to creating a safe digital environment and outlines our rigorous framework for preventing, detecting, reporting, and eradicating such abhorrent content and behavior. Any violation will result in severe consequences, including immediate and permanent termination of accounts, and will be reported to the relevant law enforcement authorities without exception.
2. Definitions
Child: Any person under the age of eighteen (18) years.
Child Sexual Abuse and Exploitation (CSAE): Any form of sexual abuse, harassment, grooming, or exploitation of a child. This includes soliciting, grooming, engaging in sexualized conversations, or attempting to meet a child for sexual purposes.
Child Sexual Abuse Material (CSAM): Any visual or audio content that depicts sexually explicit conduct involving a child. This includes photographs, videos, digital renderings, and audio recordings. Synonyms include “child pornography” or “child abuse content.”
Grooming: The process of building an emotional connection with a child to gain their trust for the purposes of sexual abuse, exploitation, or production of CSAM.
3. Prohibited Activities
Strictly prohibited on the Sikhami platform is any activity that constitutes, facilitates, or is linked to:
Creating, Uploading, or Storing CSAM: Any form of CSAM is strictly forbidden.
Accessing or Distributing CSAM: Sharing, streaming, linking to, or downloading CSAM, or engaging in clubs/networks that trade such material.
Sexualized Interaction with Minors: Engaging in sexually explicit conversations, making sexually suggestive comments, or soliciting sexually explicit material from a minor.
Grooming: Manipulative behavior aimed at fostering a relationship with a minor to facilitate future CSAE.
Arranging Exploitative Meetings: Any attempt to arrange a physical meeting with a minor for sexually exploitative purposes.
Sexual Extortion: Threatening a minor to obtain sexual favors, money, or more explicit material.
4. Our Multi-Layered Prevention and Detection Measures
We employ a robust, proactive, and multi-faceted approach to combat CSAE and CSAM:
Age Verification & Segregation: We employ a combination of technical measures and user reporting to identify and segregate users under 18. Minors are provided with heightened privacy and safety features by default.
Verifiable Parental Consent: For users identified as minors, we will obtain verifiable parental consent for data processing as mandated by the DPDP Act, 2023, ensuring a guardian is aware of the account’s existence.
Advanced Technology Scanning:
Proactive Hashing: We utilize cutting-edge technology to scan all user-uploaded content (images, videos, documents) against hashes of known CSAM provided by organizations like the National Center for Missing & Exploited Children (NCMEC) and other global databases. This occurs before the content is made public on our platform.
Grooming Pattern Detection: We utilize AI-powered tools to analyze communication patterns in direct messages and public comments to identify potential predatory “grooming” behavior.
Human Moderator Review: Our dedicated Trust & Safety team, trained specifically in identifying CSAE and CSAM, investigates user reports and escalations from our automated systems 24/7.
User Reporting Mechanisms: We provide users with highly visible and easy-to-use reporting tools (“Report” button on every piece of content and user profile) to flag suspicious behavior or content for immediate review. Reports can be made anonymously.
5. Mandatory Reporting Protocol
Sikhami is committed to full compliance with Indian law, including the Information Technology Act, 2000, POCSO Act, 2012, and CERT-In Directions.
Immediate Action: Upon identifying any apparent CSAM or a credible case of CSAE, our Trust & Safety team will:
Immediately Takedown the content and suspend all associated accounts.
Preserve Evidence in a forensically sound manner for a period mandated by law.
Reporting to Authorities: We will immediately report the incident and the preserved evidence to the relevant Indian law enforcement agencies, specifically the Cyber Crime Cell, and to the Indian Computer Emergency Response Team (CERT-In) as required by law.
Reporting to NCMEC: While based in India, in the spirit of global cooperation to eradicate CSAM, we may also report to relevant international bodies like NCMEC, which maintains partnerships with Indian authorities.
6. Employee Training and Strict Confidentiality
All Sikhami employees, especially members of the Trust & Safety, Engineering, and Customer Support teams, undergo mandatory and regular training on CSAE/CSAM detection, internal reporting procedures, and legal obligations.
All reports and investigations are treated with the utmost confidentiality to protect the privacy of victims and the integrity of law enforcement proceedings.
7. User Education and Empowerment
We believe in empowering our community to stay safe. We will:
Provide clear, age-appropriate safety guidelines within the app.
Offer resources on online safety for parents, guardians, and educators.
Maintain transparent communication about our safety features and policies.
